A PHP1.21 million credit-card claim was dismissed after proof gaps

A Philippine bank filed a collection case for PHP1,213,114.19 in principal and supplementary credit-card charges. The respondents said they had not applied for or received the principal card, had not used it, and had not authorized a supplementary card for a former office employee. ## What the courts examined The bank produced a delivery receipt, credit-card terms, statements of account and testimony from an account specialist. The trial court ordered payment. On appeal, however, the Court of Appeals found that the bank had not proved that the principal card reached the named cardholder, that the supplementary card had been authorized, or that the respondents received the billings and demand. The Supreme Court kept the dismissal in place. It said the statements of account were not enough on their own to establish that the respondents made the listed purchases. Payment entries also did not identify who had paid. The bank's own witness acknowledged that no application form supported the supplementary card, even though large purchases and cash advances later appeared under it. ## Where the case ended The Supreme Court denied the bank's petition and affirmed the dismissal of the collection complaint. That result is specific to the proof in G.R. No. 239092. It does not mean every disputed credit-card balance is invalid, and the judgment reviewed here does not establish a later account correction or credit-report update.
